1. Acceptance of Terms

By purchasing a tour from Isca Tours, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not purchase or use our services.

2. Tour Validity and Expiration

All tour codes are valid for 30 days (1 month) from the date of purchase.After this period, the tour code will expire and cannot be used. No refunds or extensions will be provided for expired tour codes.

It is your responsibility to use your tour code within the validity period. We recommend planning your visit to Exeter accordingly.

3. Liability and Waiver

IMPORTANT: ASSUMPTION OF RISK

By participating in an Isca Tours experience, you acknowledge and accept that there are inherent risks associated with walking tours and outdoor activities, including but not limited to:

  • Trips, slips, and falls
  • Traffic and pedestrian hazards
  • Weather-related conditions
  • Uneven surfaces and obstacles
  • Other hazards associated with public spaces

Release of Liability: To the fullest extent permitted by law, Isca Tours, its owners, employees, agents, and affiliates shall not be liable for any injury, loss, damage, accident, delay, or irregularity that may occur during or as a result of your participation in our tours, including but not limited to:

  • Personal injury or death
  • Property damage or loss
  • Emotional distress
  • Any indirect, consequential, or incidental damages

By purchasing and using our tour service, you hereby release, waive, discharge, and covenant not to sue Isca Tours, its owners, employees, agents, and affiliates from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury that may be sustained by you or your property, whether caused by the negligence of Isca Tours or otherwise, while participating in the tour or while on the premises where the tour is conducted.

4. Trespassing and Property Rights

PROHIBITION OF TRESPASSING

You must not trespass on private property. Our tours are designed to guide you through public spaces and areas where public access is permitted. You are responsible for:

  • Respecting private property boundaries
  • Following all posted signs and restrictions
  • Obeying local laws and regulations
  • Not entering any private property without explicit permission
  • Respecting the rights of property owners and residents

Isca Tours is not responsible for any consequences resulting from trespassing or unauthorized entry onto private property. Any legal action taken against you for trespassing is solely your responsibility.

5. Participant Responsibilities

You are responsible for:

  • Your own safety and the safety of any accompanying persons
  • Following all traffic laws and pedestrian regulations
  • Being aware of your surroundings at all times
  • Wearing appropriate footwear and clothing for walking
  • Not participating if you have medical conditions that may be exacerbated by walking
  • Supervising any children in your care
  • Respecting the environment and local community
  • Not causing damage to property or disturbing others

6. Weather and External Factors

Tours proceed in all weather conditions unless deemed unsafe. You are responsible for checking weather conditions and dressing appropriately. Isca Tours is not liable for any inconvenience or issues caused by weather or other external factors beyond our control.

7. Refunds and Cancellations

No refunds will be provided for:

  • Expired tour codes
  • Unused tour codes within the validity period
  • Weather-related cancellations by the participant
  • Participant's inability to complete the tour
  • Changes in personal circumstances

Refunds may be considered only in exceptional circumstances at the sole discretion of Isca Tours, such as technical failures on our part that prevent tour access.

8. Intellectual Property

All content provided through our tours, including text, images, audio, and other materials, is the intellectual property of Isca Tours and is protected by copyright laws. You may not reproduce, distribute, or use this content for commercial purposes without written permission.

9. Privacy and Data

We collect and use your email address and phone number to provide tour services, send tour codes, and communicate via WhatsApp. Your data will be handled in accordance with applicable data protection laws. We do not share your personal information with third parties except as necessary to process payments.

10. Modifications to Terms

Isca Tours reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

11. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
